Privacy Policy

The Harold Grinspoon Foundation (“we” and “us”), which operates the PJ Library Programme, is committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) and other applicable data protection laws.

This Privacy Policy governs the manner in which we collect, hold, use and disclose information collected from users (each, a “User” or “you”) of the www.pjlibrary.org.au (“Website”).  It does not apply to information collected offline.


The kind of information we collect

Depending on the particular circumstances, we may collect, hold and disclose a range of personal information and other information about you.  This can include:
 
  • your name, address, email address and telephone number as well as the language(s) spoken in your household;
  • the name, date of birth and gender of the child being enrolled in the PJ Library Programme as well as the school attended by the child;
  • transaction information and financial information; and
  • the browser name, the type of computer and technical information about your means of connection to our Website, such as the operating system and the Internet service providers utilised and other similar information.
This is not an exhaustive list.  From time to time, we may ask you for additional information as part of our authentication process or if we reasonably need the information to conduct our activities.

If you provide information about other individuals to us (for example, family and friends), we rely on you to inform those individuals that you are providing their personal information to us and to advise them about the contents of this Privacy Policy.


Collection of information

We may collect information in a variety of ways, including:
  • directly, such as when you enrol in the PJ Library Programme via the Website, renew your membership, subscribe to our newsletter, fill out a form or make a donation;
  • indirectly, such as when a parent or guardian enrols a child on the Website;
  • from publicly available sources of information;
  • when we are legally authorised or required to do so; and
  • through digital communications, such as when you visit our Website.
You can always refuse to supply any information to us, except that doing so may prevent you from engaging in the PJ Library Programme.
We do not knowingly collect information directly from children under the age of 16 without parental or guardian consent.  If you are under the age of 16, please do not provide us with any information about you.  If you have reasons to believe that we may have accidentally received information from a child under the age of 16, please contact us immediately.


Web browser cookies

Our Website may use “cookies” to enhance your experience.  Your web browsers place cookies on your hard drives for record-keeping purposes and sometimes to track information about you.  You may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent.  If you do so, please note that some parts of the Website may not function properly.


How we use collected information

We may use the information collected from you:
  • to carry out services under our contracts with you;
  • to send you periodic emails;
  • for the purposes of your or your child's enrolment in the PJ Library Programme and the administration of the Website;
  • to improve customer service, including personalising your experience on the Website;
  • to gain an understanding of your needs so that we may improve or develop the PJ Library Programme;
  • for our operations and for purposes that are related to one or more of our functions or activities;
  • to communicate with you (including by sending information and updates relating to any order, questions or requests) or for the provision of customer services; and
  • subject to your consent, for other purposes which will be notified to you from time to time.
If you decide to enrol in the PJ Library Programme, you will receive emails that may include news about us, updates, related service information, etc.  If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.


Direct Marketing

We may also use your information so that we and our business partners can promote and market products and/or services that we think may be of interest to you (including the products and/or services provided by a third party).  This marketing may be carried out in a variety of ways (including by email or by customising online content) and may continue after your subscription to the PJ Library Programme expires, until you opt-out.  You may opt-out by following the unsubscribe instructions at the bottom of each email you receive from us.


How we protect your information

How we hold your information may vary according to the circumstances.  For example, we may store your information in hard copy or in electronic format (on secure servers physically located at our offices).

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, modification, disclosure, misuse, interference and loss of your personal information, transaction information and other data held by us.
If you consent to us using your information for direct marketing purposes, then (after enrolling) your subscription information will be kept securely on file even after your subscription expires. 

If we collect financial information, we will offer the use of a secure server.  All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway provider's database only to be accessible by those authorized with special access rights to such systems, all of whom are required to keep the information confidential.

Unfortunately, the transmission of information via the Internet is not completely secure.  Although we will do our best to protect your personal information, we cannot guarantee the security of data you transmit to our Website; any transmission is at your own risk.  Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.


Disclosing your information

We do not sell, trade, or rent your information to third parties.

We may share generic aggregated demographic information not linked to any personal information regarding you with our business partners, trusted affiliates and advertisers for the purposes outlined above.

We partner with The Shalom Institute (ABN 75 000 729 064) to operate the PJ Library Programme in Australia.  Accordingly, your personal information will be shared with The Shalom Institute for the sole purpose of us running the PJ Library Programme in Australia.

If donations are collected then we will use a third party service provider to process your donations and we will share your information with them for that purpose only.  We may also use third party service providers to help us operate our business and the Website or administer activities on our behalf, such as sending out newsletters or surveys.  We may share your information with these third parties for those limited purposes unless you have asked us not to do so at registration or afterwards.

We may disclose personal information obtained from you to third parties:
 
  • in the circumstances set out above;
  • in the event that we sell or buy any business or assets, in which case we may disclose personal information obtained from you to the prospective seller or buyer of such business or assets;
  • if we or all of our assets are acquired by a third party, in which case personal information held by us will be one of the transferred assets; and
  • if we are under a duty to disclose or share personal information in order to comply with any legal obligation, or in order to enforce or apply our terms of use or terms and conditions and other agreements; or to protect the rights, property, or safety of the PJ Library Programme or other Users.  This includes exchanging information with other companies, law enforcement agencies and other organisations.
Your personal information will be transferred to, and stored in, the United States.  Your personal information may also be processed by staff, operating outside of Australia who work for us or for one of our suppliers.  Such staff may be engaged in, among other things, the fulfilment of your subscription, the processing of your payment details and the provision of support services.  By submitting your personal information, you agree to this transfer, storing or processing.  We will take all steps reasonably necessary to ensure that your personal information is treated securely, in accordance with this Privacy Policy and all applicable data protection laws.

Occasionally, at our discretion, we may include or offer third-party products or services on our Website.  These third-party sites have separate and independent privacy policies.  We therefore have no responsibility or liability for the content and activities of these linked sites.  Nonetheless, we seek to protect the integrity of our Website and welcome any feedback about these sites.


Accessing, updating or correcting information

If you wish to access, update or correct any of the personal information that we hold about you, you may contact us by using the details set out in the "Contacting us" section below.

The Australian Privacy Principles set out a number of principles in respect of accessing, updating and correcting your personal information.  In certain circumstances we may refuse to grant you access to your personal information.  If we refuse to give you access to, update, or correct your personal information we will provide you with a written explanation, including the reasons behind our refusal.

We may charge you an administrative fee for providing access to your information in response to a request.


How long do we keep information

Subject to applicable laws and our internal policies, we normally destroy or de-identify your information when we no longer need it.


Making a privacy complaint

If you wish to notify us of any privacy complaint you may have against us, including if you think that we have failed to comply with the Australian Privacy Principles, please contact us by using the details set out in the "Contacting us" section below.

When you contact us to notify us of a complaint, we will provide you with an estimate timeframe for our response.

While it is our intention to resolve your complaint, if you are not satisfied with our response you are entitled to contact the Office of the Australian Information Commissioner (OAIC) on 1300 363 992 or the other contact details listed on the OAIC's website (www.oaic.gov.au), who may investigate your complaint further.


Changes to this Privacy Policy

We have the discretion to update this Privacy Policy at any time.  When we do, we will post a notification on the privacy page of our Website and, if and when we consider appropriate, notify you by e-mail.  We will also update the modification date below.  We encourage you to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect.  You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications.


Your acceptance of this Privacy Policy

By using the Website, you signify your acceptance of this Privacy Policy.  If you do not agree to this Privacy Policy, please do not use the Website.  Your continued use of our Website following the posting of changes to this Privacy Policy will be deemed your acceptance of those changes.
