www.pjlibrary.org.au ("Website") is a website operated by the Harold Grinspoon Foundation ("we" and "us").  The Harold Grinspoon Foundation was established by real estate entrepreneur Harold Grinspoon and his wife, Diane Troderman, in 1993.  The address of the foundation is 67 Hunt Street, Suite 100 Agawam, Massachusetts 01001, USA.

We partner with The Shalom Institute (ABN 75 000 729 064) to operate the PJ Library Programme in Australia.  The address of The Shalom Institute is

TERMS OF WEBSITE USE

These Terms of Use (together with the documents incorporated by reference) set out the basis on which you may use the Website, whether as a guest or as a subscriber to any PJ Library Programme.  Use of the Website includes accessing or browsing the Website, enrolling in a PJ Library Programme, subscribing to our newsletter, filling out a form or, if donation functionality is added to the Website, making an online donation.

Please read these Terms of Use carefully before you start using the Website.  By using the Website you will be deemed to accept these Terms of Use and agree to be bound by them.  We recommend that you print a copy of these Terms of Use for future reference.

If you do not agree to these Terms of Use, you must not use the Website or any of our online programmes.


OTHER APPLICABLE TERMS

These Terms of Use incorporate the terms of the following policies which, for clarity, also apply to your use of the Website:
 

  • Our Privacy Policy, which sets out the terms on which we process any personal information we collect from you, or that you provide to us.  By using the Website, you consent to such processing and you warrant that all data provided by you is accurate.


ENROLMENT AND SUBSCRIPTION

We currently operate the PJ Library Programme which sends free, high-quality Jewish children’s literature and music to families with children under 9 years old.  We may in the future also operate other programmes.
 
The link to enrolment for any of our programmes can be found at www.pjlibrary.org.au/About-PJ-Library/Privacy-Policy.  In respect of enrolling in any of our programmes and the subsequent subscription, unless we specifically indicate otherwise, please be aware that the following terms and conditions apply.
 
Your submission of any form in respect of participating in a programme will be deemed to constitute acceptance of the terms and conditions below:
 
Age of child

  • The child is eligible from birth through 8 years-old at the time of enrolment.  This means that a child is eligible for the programme from birth until their 9th birthday.

Address

  • The mailing address must be within Australia. This may change in the future.

Application

  • Families with multiple eligible children may, subject to these terms, enrol once per family.
  • We have full discretion in deciding whether to accept any application for subscription to the PJ Library Programme.  If the application is rejected, the applicant will be notified by email.  The applicant is welcome to contact us on the contact details provided below to discuss our decision further with us.

Accuracy of information

  • You confirm that the information that you submit to us is complete, accurate and not misleading.
  • If you are the legal guardian or parent of the child being enrolled we will require some basic information about you as part of the application.
  • If you are not the legal guardian or parent of the child being enrolled we will require information about you as well as information about the legal guardian or parent of the child.  You confirm that the legal guardian or parent has given you permission to submit the enrolment on behalf of the child and to disclose their information to us.

Terms of subscription

  • Subscriptions last for one year, beginning from the date of enrolment, and will be renewed at our discretion.
  • Subscriptions include 10 mailings per year in the months from February through November and will be sent to the address provided. 
  • You will not receive books or other PJ Library resources during the months of December and January.
  • We are not responsible for the content of the books and resources that we send to you.  We welcome your suggestions and comments on our selection.  Please be in touch with us via our email address below.

Use of books

  • The books and the CD can only be used for personal purposes.
  • You agree to abide by any copyright and/ or data laws in respect of your use of the materials provided.

Cost of subscription

  • The programme is free of charge for subscribers.

 
CHANGES TO THESE TERMS

We may revise these Terms of Use at any time by publishing an updated version on the Website.
Please check this page from time to time to take notice of any changes we made.  By continuing to use the Website, you will be deemed to accept the updated Terms of Use and agree to be bound by them.


CHANGES TO THE WEBSITE

We may update the Website from time to time, and may change the content at any time.  However, please note that any of the content on the Website may be out of date at any given time, and we are under no obligation to update it.


ACCESSING THE WEBSITE

The Website is made available free of charge.

We do not guarantee that the Website, or any content on it, will always be available or be uninterrupted.  Access to the Website is permitted on a temporary basis.  We may suspend, withdraw, discontinue or change all or any part of the Website without notice.  We will not be liable to you if for any reason the Website is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the Website.

You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.


COLLECTION OF INFORMATION

We may collect and use any information you input into the Website, as well as information the Website collects automatically (such as the type of device you use, the IP address of your device and information about your operating system), for any of our business purposes, subject to the terms of our Privacy Policy.


NO UNLAWFUL, INFRINGING OR OFFENSIVE ACTIVITY

You must not post or transmit to, or via, the Website any information or material or otherwise use the Website for any activity which breaches any laws or regulations, infringes a third party’s rights or privacy or is contrary to any relevant standards or codes, including generally accepted community standards.  You must also not permit or enable another person to do any of those things.


YOUR ACCOUNT AND PASSWORD

We may require you to register with us in order to access some parts of the Website.

If you register with us, you must keep your registration details confidential.  You will be responsible for any access to the Website using your registration details, even if the access is by another person.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at pjadmin@shalom.edu.au.


INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in the Website, and in the material published on it.  Those works are protected by copyright laws and treaties around the world.  All such rights are reserved.

Despite the foregoing, you may print off one copy, and may download extracts, of any page(s) from the Website for your personal use and you may draw the attention of others within your organisation or family to content posted on the Website.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on the Website must always be acknowledged appropriately.
You must not use any part of the content on the Website for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of the Website in breach of these Terms of Use, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.


NO RELIANCE ON INFORMATION

The content on the Website is provided for general information only.  It is not intended to amount to advice on which you should rely.  You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Website.


WARRANTIES AND REPRESENTATIONS

Subject to the provisions of the "Liability" section below, and otherwise to the maximum extent permitted by law, you acknowledge and agree that the Website is made available to you on an "as is" and "as available" basis, without any express or implied warranty of any kind.  Without limiting the foregoing, we do not represent or warrant that the content on the Website is accurate, reliable, suitable, complete or up-to-date.


LIABILITY

Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (being Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement ("Non-Excludable Guarantee").

To the maximum extent permitted by law, our liability for breach of a Non-Excludable Guarantee is limited, at our option, to either re-supplying or paying the cost of re-supplying the information, link or associated service (as the case may be).

Except as set out above, and otherwise to the maximum extent permitted by law, we are not liable to you or any other person for any:
 

  • liability, loss, damage, claim, cost or expense incurred by you, whether arising under contract, statute, tort (including negligence), in equity, by operation of law or otherwise; or
  • indirect, punitive, incidental, reliance, special, exemplary or consequential loss or damage, any loss of business, loss of management time, loss of opportunity, loss of revenues, loss of savings, loss of profits, loss or corruption of data, loss of goodwill or other intangible losses (even if we have been advised of the possibility of such loss or damages), arising out of or in connection with the Website or its content.


VIRUSES

We do not guarantee that the Website will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform in order to access the Website.  You should use your own virus protection software.

You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.  You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website.  You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack.  We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.  In the event of such a breach, your right to use the Website will cease immediately.


LINKING TO THE WEBSITE

You may link to the Website's home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

PJ Library is a registered trademark of the Harold Grinspoon Foundation.  You must not use this trademark or the name of the Harold Grinspoon Foundation without our prior written consent.


SUSPENSION AND TERMINATION

We may suspend or terminate your access to all or any part of the Website at any time, if, in our reasonable opinion, you breach these Terms of Use.


APPLICABLE LAW

These Terms of Use are governed by the law in force in the State of New South Wales, Australia.  You irrevocably submit to the exclusive jurisdiction of the courts of that State in respect of all matters arising out of or relating to these Terms of Use or the Website.
